Misrepresentation and failure to provide the required due diligence to investor clients are all serious forms of broker misconduct. The firm that the broker is employed with is responsible for supervising and preventing misconduct of this nature. Failure to supervise is a claim that typically is alleged in these circumstances.
Failure to provide due diligence occurs when a broker/brokerage firm fails to ensure that the proper inquiry investigations occur with regards to the securities that they are investing investor funds into. The brokerage firm is required to appoint a manager to facilitate these investigations and brokers employed by the brokerage firm are expected to comply with industry regulations relating to due diligence for investor clients.
Misrepresentation occurs when a broker provides false and/or misleading information to investors with the objective of obtaining their investment. If you invested your capital due to misleading information that was provided to you by a broker willingly or by a broker that did not perform their due diligence to verify the securities you were investing with, then you have the potential of recovering some or even all of your money through FINRA arbitration.
FINRA arbitration is a streamlined way to recover your funds that were lost due to failure to provide due diligence or misrepresentation. The Silver Law Group solely works on a contingency fee basis, which means that you will not have to pay any fees upfront until we recover money for you.
