Silver Law Group is Investigating Joseph Alan Lavigne of Spencer Edwards, Inc.

Silver Law Group is currently investigating Centennial, Colorado based broker Joseph Alan Lavigne regarding complaints pertaining to failure to provide due diligence to investor clients and misrepresentation.

Based on FINRA’s BrokerCheck report on Lavigne, a complaint was filed on December 4, 2017 alleging that Lavigne provided misleading information to investor clients during his employment at Spencer Edwards, Inc. The total in damages was $47,034.75.

Lavigne was previously employed at Bathgate Capital Partners LLC from 2002 to 2013. He has been employed at Spencer Edwards, Inc. from 2013 to the present.

The firm that the broker is employed with is responsible for supervising and preventing misconduct of this nature. Failure to supervise is a claim that typically is alleged in these circumstances.

Failure to provide due diligence occurs when a broker/brokerage firm fails to ensure that the proper inquiry investigations occur with regards to the securities that they are investing investor funds into. The brokerage firm is required to appoint a manager to facilitate these investigations and brokers employed by the brokerage firm are expected to comply with industry regulations relating to due diligence for investor clients.

Misrepresentation occurs when a broker provides false and/or misleading information to investors with the objective of obtaining their investment.
